【音頻解讀】《持永久居留身份證外籍人員創辦科技型企業試行辦法》政策解讀 持永久居留身份證外籍人員創辦科技型企業試行辦法 window.audiojs.events.ready(function() { window.audiojs.create(document.getElementById("audio_94622782836996430")); }); 　　一、背景依據　　根據《中共中央國務院關于深化體制機制改革加快實施創新驅動發展戰略的若干意見》（中發〔2015〕8號）和中共中央、國務院印發的《粵港澳大灣區發展規劃綱要》的精神，市科技局會同市發展改革委、市場監管局等單位研究制定了《持永久居留身份證外籍人員創辦科技型企業試行辦法》（以下簡稱《試行辦法》）。此項政策的出臺，將進一步便利外籍人才在穗創新創業，為進一步優化廣州市營商環境，支持持有外國人永久居留身份證（外國人永久居留證）的外籍人員以科技創業方式參與粵港澳大灣區國際科技創新中心建設提供政策指引。　　二、試點區域及時間　　《試行辦法》在廣州市全市范圍內實施。《試行辦法》自2021年8月1日起實施，試行期為3年。　　三、政策主要內容　　（一）《試行辦法》僅針對特定群體的特定事項的特定權益，即“持有中華人民共和國外國人永久居留身份證（外國人永久居留證）的外國自然人”在創辦“科技型企業”方面享受國民待遇。　　（二）外籍人員創辦企業的待遇方面，是指外籍人員可憑其持有的外國人永久居留身份證（外國人永久居留證）作為創辦科技型企業的身份證明，與境內自然人持中國居民身份證作為身份證明創辦企業享受同等待遇，并根據《中華人民共和國外商投資法》及其實施條例等相關規定辦理商事登記。　　（三）《試行辦法》還明確了注冊企業的類型。本辦法僅限于注冊的企業類型為科技型企業。所指的科技型企業是指從事技術開發、技術轉讓、技術咨詢、技術服務、技術檢測或高新技術產品（服務）研發、生產、經營的企業。企業可以從事科技及科技相關的行業。注冊的企業類型可選擇注冊為股份有限公司、有限責任公司、合伙企業。　　（四）《試行辦法》還提出了鼓勵技術創新。鼓勵外籍人員以自有知識產權、專有技術等非貨幣財產作價出資創辦科技型企業。　　（五）《試行辦法》還明確了外籍人員創辦科技型企業時，應按照有關規定向市場監督管理部門辦理注冊登記。　　[ The Chinese version shall prevail for the final interpretation of these Measures, and the English translation is for reference only. ]　　Trial Measures for the Establishment of Scientific and Technological Enterprises by Foreigners with Permanent Resident ID Card　　Article 1 These Measures are formulated in accordance with the Several Opinions of the CPC Central Committee and the State Council on Deepening the Reform of Systems and Mechanisms to Accelerate the Implementation of Innovation-driven Development Strategies to further optimize the business environment of Guangzhou City and support foreigners holding Foreign Permanent Resident ID Card (Foreigner’s Permanent Residence Card) to participate in the construction of international science and technology innovation center in Guangdong-Hong Kong-Macao Greater Bay Area by means of scientific and technological entrepreneurship.　　Article 2These Measures shall be applicable in Guangzhou.　　Article 3 The foreigners with permanent resident ID cards referred to in these Measures are foreign natural persons who have been approved to obtain permanent residence status in China and hold foreign permanent resident ID cards (foreigner’s permanent residence cards) of the People's Republic of China.　　Article 4The foreigners with foreign permanent resident ID cards (foreigner’s permanent residence cards) to establish scientific and technological enterprises shall receive the same treatment as domestic natural persons, that is, foreigners can use their foreign permanent resident ID cards (foreigner’s permanent residence cards) as proof of identity to establish scientific and technological enterprises, and enjoy the same treatment as domestic natural persons holding Chinese resident ID cards as proof of identity. Commercial registration shall be undertaken according to the Foreign Investment Law of the People's Republic of China and its implementing regulations.　　Article 5The scientific and technological enterprises referred to in these Measures are enterprises engaged in technology development, technology transfer, technology consultation, technology services, technology testing or R & D, production and operation of high-tech products (services). Enterprises in this category may be engaged in technology and technology-related industries. They may be registered as joint stock limited companies, limited liability companies or partnership enterprises.　　Article 6 Foreigners are encouraged to invest in the establishment of scientific and technological enterprises with their own intellectual property rights, proprietary technology and other non-monetary assets.　　Article 7 The foreigners with foreign permanent resident ID cards (foreigner’s permanent residence cards)  to establish scientific and technological enterprises shall apply to the market supervision and administration department for registration.　　Article 8These Measures also apply to the case of new foreigners holding permanent resident ID cards as investors.　　Article 9 These Measures shall come into force from August 1, 2021 and shall be valid for 3 years.
